The United States Constitution is a guaranty of individual freedom, and places restrictions on the powers of the federal government. In the preamble to the Constitution, the framers made it clear that it is designed to “secure the blessings of liberty to ourselves and to our posterity.” There are many core freedoms expressed in the Constitution, including the freedom of speech, the freedom of assembly, the freedom of religious expression, and the freedom to own property.
These freedoms are essential to the “blessings of liberty” and one is no more worthy of defense than another.
“The reason why men enter into society is the preservation of their property.”
- John Locke
“Property is surely a right of mankind as real as liberty.”
- John Adams
Years ago, the United States Supreme Court stated:
“In fact, a fundamental interdependence exists between the personal right to liberty and the personal right in property. Neither could have meaning without the other. That rights in property are basic civil rights has long been recognized.”
Lynch v. Household Financial Corporation, 405 US 538, 552 (1972)
Unfortunately, property rights have been under attack for years in California and in other states throughout the nation. The government often attempts to take private property without just compensation on the theory that the needs of the public outweigh the rights of the individual. This philosophy is at odds with the Constitution, which is designed to protect the rights of the individual.
